An all-way or 4-Way stop sign in a neighborhood with trees, houses, and mountains in the background

Understanding How Four-Way Stops Work

By Car Accident

Coming to a four-way stop sometimes feels like a game of “who goes first?” With drivers from all directions looking to make their move, understanding how 4-way stops work is important for safety. Whether you are a seasoned driver or a beginner, these intersections can be confusing. Knowing the rules can make all the difference in avoiding accidents and staying safe.

Who Has the Right of Way?

Approaching a four-way stop can sometimes feel uncertain, but clear right-of-way rules keep traffic organized and smooth. If you arrive first at the four-way stop, you have the right to continue. When two cars stop at the same time, the driver to your right moves first. If two cars approach from opposite directions, the driver going straight has priority over a driver turning left. Most importantly, pediatricians and cyclists often have the right of way. Staying alert and understanding these rules makes intersections safer for everyone.

Common Mistakes Made at Four-Way Stops

Four-way stops require patience, awareness, and a clear understanding of the rules.

Unfortunately, mistakes happen:

  • Rolling through the stop instead of coming to a full halt can lead to collisions.
  • Failing to yield to pedestrians and cyclists creates serious risks.
  • Misjudging arrival order may cause two drivers to move at once.
  • Confusing right-of-way leads to hesitation and dangerous assumptions.
  • Not paying attention to the car ahead can result in sudden stops or near-misses.

These errors can cause frustration and dangerous situations. Following the rules and maintaining attention helps traffic flow smoothly and safely.

Your Next Steps with Fielding Law

At a four-way stop, everyone has a role in keeping traffic flowing smoothly. However, even with the best intentions, accidents can happen. While the rules are straightforward, dealing with the aftermath of an accident can be anything but simple. If you are in such a situation, it is important to know what steps to take and how to protect your rights.

The Cost of a St. Patrick’s Day DUI

By Car Accident, Catastrophic Injury, Personal Injury, Wrongful Death
St. Patrick’s Day is a time for festive celebrations, but the consequences of driving under the influence (DUI) can quickly turn the holiday into a nightmare. Understanding the true cost of a St. Patrick’s Day DUI can help prevent poor decisions and keep everyone safer on the road.

Legal Consequences of a DUI

Driving under the influence is a serious offense with significant legal repercussions. These can include:

  • Criminal Charges: A DUI often results in misdemeanor or felony charges depending on the circumstances, such as prior offenses or injuries caused.
  • Fines: First-time offenders can face fines ranging from hundreds to thousands of dollars.
  • License Suspension: A DUI conviction often leads to a suspended or revoked driver’s license, severely limiting mobility.
  • Jail Time: Depending on the severity of the case, jail time is a possibility even for first-time offenders.
  • Probation: Many DUI offenders are required to complete probation and attend mandatory alcohol education programs.

Financial Consequences of a St. Patrick’s Day DUI

The financial impact of a DUI extends far beyond the initial fines. Additional costs include:

  • Increased Insurance Rates: A DUI conviction will likely cause your car insurance premiums to skyrocket, costing you thousands over time.
  • Legal Fees: Attorney costs and court fees can quickly add up, even for minor offenses.
  • Towing and Impound Fees: Arrests often result in vehicle impoundment, leading to additional expenses.
  • Lost Wages: Time spent dealing with court dates, license suspension, or jail time can result in significant lost income.
  • Rehabilitation Costs: Court-mandated alcohol education or treatment programs are often required and are not free.

Injuries and Liability in St. Patrick’s Day DUI Accidents

Beyond personal legal and financial penalties, driving under the influence puts countless lives at risk. Drunk drivers who cause accidents are not only held criminally responsible but are also liable for the injuries and damages they cause. Victims of such accidents may face extensive medical bills, lost wages, and emotional trauma.

If you or a loved one is injured by a negligent drunk driver, you have the right to seek compensation. Fielding Law can help you navigate the legal process and hold the responsible party accountable.

Why Hire Fielding Law?

At Fielding Law, we specialize in personal injury cases caused by drunk drivers. Our dedicated team is here to ensure victims receive the justice and compensation they deserve. Adjusting to Daylight Saving Time: Springing Forward

By Personal Injury

Spring Forward: What is Daylight Saving Time?

Daylight Saving Time (DST) begins on Sunday, March 9, and it marks the “spring forward” shift in which we set our clocks one hour ahead. This change is meant to maximize daylight during the longer spring and summer days. By shifting the time, we gain an extra hour of daylight in the evening, which allows for more outdoor activities after work or school. Originally introduced to conserve energy, today DST helps us make the most of longer days.

How to Prepare for the Time Change

Adjusting to the time change can sometimes feel like a challenge, especially if you are not a morning person or struggle with sleep. While it may seem like just an hour, the shift can affect your sleep patterns, energy levels, and overall well-being. Here are some tips for preparing and adjusting smoothly:

  • Adjust Your Sleep Schedule Gradually
One of the best ways to prepare for the time change is to adjust your sleep schedule gradually. Starting a few days before DST begins, go to bed 15 minutes earlier each night. This will help your body slowly adjust to the new time, making the change easier when Sunday morning arrives.

  • Get Plenty of Morning Sun
The key to resetting your internal clock is sunlight. The morning sun helps signal to your body that it is time to wake up, while also giving you a burst of natural energy. After the time change, try to spend at least 10-15 minutes outside in the sunlight as soon as you wake up. This can help you adjust more quickly and improve your mood and alertness throughout the day.

  • Avoid Stimulants in the Evening
Caffeine, nicotine, and heavy meals late in the day can disrupt your sleep and make it more difficult to fall asleep. To make the transition to DST easier, avoid drinking coffee or tea after 2:00 PM, and try to have lighter meals in the evening. Creating a relaxing bedtime routine can also help you fall asleep more easily and get a restful night’s sleep.

  • Take Naps If Needed
If you feel particularly groggy or tired in the days after the time change, taking short naps (20-30 minutes) can help recharge your energy. However, avoid napping too late in the day, as this can interfere with your ability to sleep that night.

Stay Safe During Daylight Saving Time

While the shift to longer days is a welcome change, it does bring some risks. Studies have shown that accidents—especially car crashes—are more common around the time of the time change. Sleep deprivation, combined with changes in lighting conditions, can make people more prone to accidents. Drivers may be disoriented by the new light levels, while pedestrians may not adjust their behavior to the longer daylight hours.

Here are a few things to keep in mind as you transition into DST:

  • Be Extra Cautious on the Roads
If you are driving, make sure you are well-rested. Sleep deprivation can impair your reaction time and alertness. Additionally, the shift in daylight hours means you might be driving in conditions that feel unfamiliar. For example, early morning light might feel darker than usual, and evening sunlight may be blinding. Always keep your headlights on when visibility is low, and be especially cautious at dawn and dusk.

  • Watch for Pedestrians
As the days grow longer, more people may be out walking or running during the evening hours. Drivers should be on the lookout for pedestrians crossing streets, especially in areas where there may be reduced visibility. Pedestrians should also take extra care when crossing streets, as changes in light levels could affect their ability to see oncoming traffic.

Impact on Personal Injury Cases

If you are involved in an accident during or after the time change, you may face additional challenges due to the sleep disruptions and changes in road conditions. For example, if you are injured in a car accident or pedestrian accident shortly after the time change, the driver’s or your own lack of attention due to sleep deprivation could be a contributing factor. It is important to seek legal advice if you have been injured to ensure you understand your rights and options moving forward.

At Fielding Law, we are here to help you through any personal injury case, whether it is a car accident, slip and fall, or any other injury caused by negligence. We understand that accidents can happen when people are adjusting to the time change, and we are committed to ensuring you receive the compensation you deserve for your injuries.

Why Hire Fielding Law?

At Fielding Law, our experienced attorneys are dedicated to helping individuals who have been injured due to the negligence of others. We understand how stressful and overwhelming it can be to deal with an injury, especially if it happens during a transition like Daylight Saving Time. Court-Appointed Arbitrator Arizona: Clark H. Fielding’s Role in Justice

By Firm News and Celebrations, In the Community, Personal Injury

What It Means to Be a Court-Appointed Arbitrator in Arizona

At Fielding Law, we are proud to share that Clark H. Fielding has once again been trusted to serve as a court-appointed Arbitrator in Arizona for the Superior Court of Arizona, Maricopa County. This is not a new role for Clark. For years, the court has relied on his knowledge, fairness, and dedication to help resolve cases efficiently and with care. His appointment in Case No. CV2024-011405 is just one more example of the respect he has earned within the legal community. But what exactly does an Arbitrator do, and why does this matter to you?

Understanding Court-Ordered Arbitration in Arizona

Many civil cases in Maricopa County go through compulsory arbitration. This process applies to certain disputes, usually those involving claims under a specific monetary amount.

Instead of facing a full trial with a judge or jury, these cases move to arbitration. There, an experienced attorney like Clark H. Fielding serves as the Arbitrator. He listens carefully to both sides. Then, after reviewing the facts, he makes a fair decision based on Arizona law.

This system helps resolve cases more efficiently. It also reduces the burden on the courts while ensuring each case still receives thoughtful attention.

How Are Court-Appointed Arbitrators Selected?

The court carefully chooses court-appointed Arbitrators in Arizona. Not every attorney qualifies. To serve in this role, an attorney must:

  • Stay active with the State Bar of Arizona.
  • Maintain good standing without any disciplinary issues.
  • Have a minimum level of experience practicing law.
  • Accept appointments as part of their professional duties.

The Superior Court’s Arbitration Department manages these appointments. They assign Arbitrators on a rotating basis from a list of qualified attorneys. This ensures fairness and balance across cases.

What Does an Arbitrator Do?

An Arbitrator’s job is to provide a fair hearing. During the arbitration, the Arbitrator listens to both parties and reviews all the evidence. After careful consideration, they issue an Award. This decision explains who is legally responsible and outlines any damages owed.

Although arbitration is less formal than a traditional trial, it remains an official legal process. In some cases, either party can appeal the decision and request a trial. However, many cases find resolution at the arbitration stage, saving time and resources for everyone involved.

Clark FieldingHow Clark’s Appointment Reflects Fielding Law

The court only appoints trusted attorneys as Arbitrators. These individuals must demonstrate not only strong legal skills but also fairness, integrity, and professionalism.

Clark H. Fielding earned this appointment because of his proven dedication to justice. His reputation as a knowledgeable and reliable attorney made him a clear choice to serve as a court-appointed Arbitrator in Arizona.

At Fielding Law, this same commitment drives everything we do. Whether Clark is leading our team, helping clients after serious injuries, or serving the community through arbitration, his focus remains the same. He works to make the legal system approachable, fair, and effective.

When you choose Fielding Law, you work with a team that is respected both inside and outside the courtroom. We understand the legal process and use that knowledge to guide our clients with care, clarity, and confidence.

Poolside Accidents You Never See Coming

By Personal Injury, Premises Liability, Public Entity

Imagine a fun sunny day at the pool turning into a serious risk you never thought would happen. Every year, thousands of people suffer pool-related injuries, from minor slips to life-threatening drownings. These accidents can occur at public pools, hotels, private homes, and vacation rentals. Stay protected at the pool by understanding your rights, state laws, and insurance coverage.

Common Pool Injuries and Their Causes

Swimming pools can be dangerous when safety precautions are overlooked. For young children, drowning is the leading cause of accidental death, often resulting from a lack of barriers, no supervision, or untrained lifeguards. Even near-drowning incidents can have lasting effects, such as brain damage.

Beyond drowning risks, pool decks often become slick with water, increasing the chances of serious slip-and-fall injuries. These can result in fractures or concussions. Likewise, diving into shallow water is extremely dangerous and can cause severe spinal cord damage, sometimes leading to lifelong paralysis.

It might go undetected, but improper chemical maintenance can pose another serious threat. If chlorine or pH levels are not balanced, swimmers may experience chemical burns, infections, or breathing difficulties. When safety measures are ignored, the risk of serious accidents increases.

Who Is Responsible for Pool Injuries?

Pool safety is a shared responsibility. While property owners must meet safety standards and maintain their facilities, parents and swimmers also play essential roles. Parents should never assume someone else is watching their child, even when lifeguards are present. Drowning can happen in seconds, and every moment counts. Swimmers should also take responsibility by making safe choices, such as never swimming alone or underestimating water depth. Pool safety requires teamwork, and when everyone plays their part, tragic accidents become less likely.

Safety Tips to Prevent Pool Injuries

Stay protected at the pool by building awareness and preparation. Always supervise children, even if they know how to swim, as drowning can happen quickly and quietly. Installing proper safety barriers, such as fences and self-latching gates, can help prevent unsupervised access. Before getting in the water, check for potential hazards like loose tiles, broken liners, or slippery surfaces. Taking these precautions helps create a safer environment for family and friends.

Your Next Steps with Fielding Law

Nothing is more important than the safety of you and your loved one. Unfortunately, many pool-related accidents result from negligence and unsafe conditions. Stay protected at the pool by practicing safety precautions and holding property owners accountable. The team at Fielding Law is ready to fight for your rights. Call us at 833.88.SHARK for a free consultation.

Brain Injuries and Misconceptions

By Brain Injury (TBI), Car Accident, Catastrophic Injury, Personal Injury, Public Entity, Slip or Trip and Fall, Wrongful Death

Brain injuries are serious and often misunderstood casualties of accidents, such as car crashes, slip-and-fall incidents, or workplace injuries. Misconceptions about brain injuries can lead to delayed treatment, underestimated symptoms, and missed opportunities for proper care. This series of false judgments can complicate personal injury claims, making it difficult for victims to receive the compensation they deserve.

MYTH: Mild Concussions Are Not Mild

The term “mild concussion” can be misleading, causing some to believe that the injury will not lead to serious consequences. However, the truth is that such injuries can have lasting effects, often more severe than they initially appear.

Insurance companies often downplay these injuries, aiming to reduce payouts and leaving injured individuals without proper compensation. The aftermath of even a mild concussion can cause memory loss, difficulty concentrating, and emotional changes that can affect a person’s life for months or even years.

It is essential to seek immediate medical care after a head injury and keep detailed records for health reasons and legal protection. Having thorough documentation can help play a big role if you need to pursue compensation or seek legal action.

MYTH: Symptoms Do Not Always Appear Right Away

Sometimes, the symptoms of a brain injury can be subtle, especially in the hours following an accident. It is not uncommon for someone to feel relatively normal but begin experiencing difficulties later. Problems such as headaches, dizziness, or mood changes may go unnoticed, yet they are often signs of a more serious injury. Without recognizing these signs early, it may be harder to connect the injury to the accident. That is why it is important to receive medical care right away.

MYTH: You Can Recover Without Treatment

Many believe that brain injuries will heal on their own with time. However, this is a dangerous misconception. The brain is an intricate organ, and even a seemingly mild injury can have lasting effects if left untreated. Brain injuries often require more than just rest; they demand specialized treatment to address the physical, emotional, and cognitive challenges that may arise.

As you consider a personal injury claim, it is important to factor in the costs of these necessary treatments. The road to recovery may involve lifelong support. The team at Fielding Law understands how it is key to receive compensation for both your current and future medical needs. Consider working with professionals so you can focus on recovering with care and support.

FACT: Fielding Law is There for You

Understanding the truth behind the misconceptions about brain injuries is important for protecting your health and legal rights. Myths can lead to significant delays in treatment and challenge your ability to pursue a fair personal injury claim. You do not have to face these complicated medical and legal obstacles alone.

At Fielding Law, we provide knowledgeable support every step of the way. Our team is dedicated to helping you navigate the path to recovery and justice. With our free consultation, we are committed to giving you the compensation you deserve. Call us at 833.88.SHARK if you or your loved one has experienced a brain injury.
